SOUTH WHITEHALL TOWNSHIP PUBLIC NOTICE Notice is hereby given pursuant to the Local Tax Enabling Act and the First Class Township Code that the Board of Commissioners of South Whitehall Township, Lehigh County, Pennsylvania, will hold a public meeting on Wednesday, December 3, 2025 beginning at 7:00 p.m., at the Township Municipal Building located at 4444 Walbert Avenue, Allentown, Lehigh County, PA 18104, for the purpose of voting on whether or not to enact a proposed ordinance. The proposed new ordinance, of which this Notice is a summary, includes the following: "AN ORDINANCE IMPOSING AN ADDITIONAL EARNED INCOME TAX FOR TOWNSHIP RESIDENTS AT THE RATE OF ONE TENTH OF ONE PERCENT (0.1%) UNDER THE AUTHORITY OF THE LOCAL TAX ENABLING ACT AND OPEN SPACE LANDS ACQUISITION AND PRESERVATION ACT, WHICH SHALL AMEND THE SOUTH WHITEHALL TOWNSHIP CODE, CHAPTER 328 (TAXATION) ARTICLE V (EARNED INCOME AND NET PROFITS TAX) SECTION 328-33 (IMPOSITION OF TAX) TO REFLECT THE ADDITIONAL TAX, AND FURTHER PROVIDING FOR THE FOLLOWING ADDITIONAL CLAUSES: REPEALER, SEVERABILITY, FAILURE TO ENFORCE NOT A WAIVER, AND EFFECTIVE DATE." The proposed ordinance imposes an additional Earned Income Tax (EIT) of one-tenth of one percent (0.1%) on Township residents, effective January 1, 2026. This tax was authorized by voter referendum held on November 4, 2025, under the Pennsylvania Open Space Lands Acquisition and Preservation Act. The additional tax will be used exclusively for open space purposes, including the purchase, improvement, and maintenance of land for conservation, recreation, and the protection of natural resources. The current general EIT rate of one-half percent (0.5%) will remain unchanged, resulting in a combined resident rate of 0.6%. The ordinance also amends Chapter 328 of the South Whitehall Township Code to reflect the new open space tax, and includes standard clauses for repealer, severability, and enforcement, and will take effect immediately upon adoption. A copy of the proposed ordinance in full-text is available for public inspection at the South Whitehall Township Municipal Building located at 4444 Walbert Avenue, Allentown, PA 18104 during normal business hours where it may be examined without charge or obtained for a charge not greater than the cost thereof, or for inspection during normal business hours at the offices of this newspaper.
