NOTICE OF PUBLIC HEARING AND POTENTIAL ADOPTION OF AMENDMENTS TO SUBDIVISION AND LAND DEVELOPMENT ORDINANCENorth Whitehall Township, Lehigh County, Pennsylvania Notice is hereby provided pursuant to Section 107, and Subsections 505(a) and 506(a) of the Pennsylvania Municipalities Planning Code, Act of Jul. 31, 1968, P.L. 805, No. 247, as amended (the "MPC"), 53 P.S. §§ 10107, 10505(a), and 10506(a), that the Board of Supervisors (the "Board") of North Whitehall Township, Lehigh County, Pennsylvania (the "Township") will hold a public hearing during the Board's regularly-scheduled public meeting on Monday, December 1st, 2025, commencing at 7:00 p.m. at the Township's Municipal Building located at 3256 Levans Road, Coplay, Pennsylvania 18037, for the purpose of receiving public comment and input concerning the adoption of amendments to the North Whitehall Township Subdivision and Land Development Ordinance of 1999 (the "SALDO"), as the same has been amended and codified in Chapter 375 of the Code of the Township of the North Whitehall (the "Code"). The proposed amendments are identified in proposed Ordinance No. 2025-4 (the "Ordinance"). Notice is also hereby provided pursuant to Subsection 1601(a) of the MPC, 53 P.S. § 10601(a), and Subsection 1601(a) of Pennsylvania's Second Class Township Code, Act of May 1, 1933, P.L. 103, No. 69, as amended (the "SCTC"), 53 P.S. § 66601(a), that the Board intends to consider passage of the Ordinance during the Board's regularly-scheduled public meeting described above. The following constitutes the title and a brief summary of the Ordinance as prepared by the Township Solicitor. The title of Ordinance No. 2025-4 is "AN ORDINANCE AMENDING THE NORTH WHITEHALL TOWNSHIP SUBDIVISION AND LAND DEVELOPMENT ORDINANCE OF 1999 AS AMENDED AND CODIFIED IN CHAPTER 375 OF THE CODE OF THE TOWNSHIP OF NORTH WHITEHALL." The Ordinance will become effective immediately upon adoption. All other ordinances or parts thereof in conflict with the Ordinance are repealed to the extent of such conflict. The Ordinance contains a Statement of Legislative Findings explaining its history, purpose, intent, and rationale, and the Ordinance also contains a savings clause. The Board anticipates adopting a new zoning ordinance and new zoning district map simultaneous with the adoption of the Ordinance. The SALDO presently contains cross-references to the Township's current official zoning ordinance. Upon adoption of the new zoning ordinance, these cross-references will be rendered obsolete. To that end, the Ordinance updates the cross-references to the Township's official zoning ordinance that are presently contained in the SALDO, so that these cross-references will not be rendered obsolete upon the adoption of the new Zoning Ordinance. The Ordinance also takes Section 440-91 (Water Service) from the Township's current zoning ordinance, as codified in Chapter 440 of the Code, and transfers this Section verbatim to the SALDO along with accompanying definitions. Copies of Ordinance No. 2025-4 may be examined without charge or obtained at the Township's Municipal Building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during normal business hours, Monday through Thursday, 7:30 a.m. to 5:00 p.m. In addition, and in accordance with Subsection 1601(a) of the SCTC, 53 P.S. § 66601(a), and Subsection 506(a)(1)-(2) of the MPC, 53 P.S. § 10506(a)(1)-(2), a full copy of the Ordinance has been supplied to this newspaper and the Lehigh County Department of Law.
