ORDINANCE 2025-2
Notice is hereby provided pursuant to Subsection 1601(a) of the Second Class Township Code, Act of May 1, 1933, P.L. 103, No. 69, as amended (the "SCTC"), 53 P.S. § 66601(a), that the Board of Supervisors of North Whitehall Township, Lehigh County, Pennsylvania (the "Board") intends to consider for adoption at its regularly scheduled public meeting commencing at 7:00 P.M. on MONDAY, NOVEMBER 3, 2025, at the North Whitehall Township Municipal Building located at 3256 Levans Road, Coplay, Pennsylvania 18037, proposed Ordinance No. 2025-2 (the "Ordinance").
Generally, the purposes of the Ordinance are to: (i) adopt the 2024 International Fire Code® ("2024 IFC") and incorporate same into Chapter 239 of the Code of the Township of North Whitehall ("Chapter 239") which, in turn, is designated by the Ordinance as the Township's official fire code; (ii) establish a system of regular, uniform fire and life safety inspections of certain non-residential buildings within the Township; and (iii) amend Part I of Chapter 239 to render it consistent with the substance of the Ordinance, which will be codified in Part II of Chapter 239. The following constitutes the title and a brief summary of the Ordinance, prepared by the Township Solicitor, setting forth all the provisions of the Ordinance in reasonable detail in accordance with Subsection 1601(a) of the SCTC, 53 P.S. § 66601(a).
The title of the Ordinance is: "AN ORDINANCE OF THE TOWNSHIP OF NORTH WHITEHALL, LEHIGH COUNTY, PENNSYLVANIA, AMENDING CHAPTER 239, PART I, OF THE CODE OF THE TOWNSHIP OF NORTH WHITEHALL; DESIGNATING CHAPTER 239 OF THE CODE OF THE TOWNSHIP OF NORTH WHITEHALL AS THE TOWNSHIP'S OFFICIAL FIRE CODE; ADOPTING THE 2024 INTERNATIONAL FIRE CODE® AND INCORPORATING SAME INTO THE TOWNSHIP'S OFFICIAL FIRE CODE; SUPPLEMENTING, MODIFYING, AND DELETING CERTAIN PROVISIONS OF THE 2024 INTERNATIONAL FIRE CODE®; AND ESTABLISHING A FIRE AND LIFE SAFETY INSPECTION PROGRAM WITHIN THE TOWNSHIP."
The Ordinance contains a statement of legislative findings identifying the Ordinance's purposes and setting forth the authority of the Board to adopt the Ordinance. Section 1 amends the existing Part I of Chapter 239 which contains requirements for the provision of key lock boxes for certain buildings within the Township. More specifically, Section 1 amends Part I of Chapter 239 to replace the term "Fire Marshal" with the term "Fire Code Administrator." Section 1 also amends Chapter 239 to insert a new provision (to be codified as Section 239-8) that identifies that all of Chapter 239 must be read in pari maeria and shall constitute the Township's official fire prevention code. Finally, Section 1 amends Chapter 239 to remove the existing Section 239-8 (violations and penalties) and move same to Part II of Chapter 239 with such provisions applicable to any violation of Chapter 239, not just part I thereof.
Section 2 sets forth the Ordinance's intent and purpose, which is to adopt the 2024 IFC and to implement a uniform system of regular inspections of certain non-residential buildings to mitigate potential fire risks and protect the health, safety, and welfare of the general public, including Township residents. Section 3 specifies that the Township's Fire Code Administrator is responsible for implementing, administering, and enforcing all provisions of Chapter 239. Section 4 adopts the 2024 IFC, and incorporates same into Chapter 239 with certain modifications, deletions, and supplementations thereof noted in the Ordinance.
Section 5 provides that if there is any conflict between the provisions of Chapter 239 and the Uniform Construction Code (UCC), then the provisions of the UCC shall control. Section 6 identifies which buildings and structures are subject to fire and life safety inspections. These include the following occupancy classifications, as identified in the 2021 International Building Code® (the "IBC"): Assembly: A-1, A-2, A-3, A-4, A-5; Business: all business occupancies, except those which are conducted within a dwelling or on a lot for which the principal use thereof is a dwelling in accordance with the Township's Zoning Ordinance (unless an inspection is required as a condition of approval of zoning relief by the Zoning Hearing Board); Educational: all occupancies; Factory: all occupancies; High Hazard: H-1, H-2, H-3, H-4, H-5; Institutional: I-1, I-2, I-3, I-4; Mercantile: all occupancies; Storage: S-1, S-2; and Utility and Miscellaneous: certain structures within this occupancy group may be subject to inspections in the sole discretion of the Fire Code Administrator, but agricultural buildings (as defined in the IBC), are exempt from such inspections and may be inspected upon the voluntary request of the agricultural building's owner.
Section 7 clarifies that the Fire Code Administrator is authorized to conduct inspections of structures identified in Section 6 for the purpose of determining compliance with Chapter 239. Section 8 identifies the following subjects of inspection:
proper use of the structure in accordance with its occupancy use classification; cooking hood fire protection systems; portable fire extinguishers; fire protection devices and systems, including standpipes and sprinkler systems; fire, smoke, and other safety alarm devices or systems; emergency power systems; exit and emergency area lighting; storage of materials; stacking and storage of combustible materials; exit/emergency egress doors; records of fire protection and alarm system tests; address identification; other items required by the Uniform Construction Code (as adopted by 34 Pa. Code § 403.21) or the National Fire Protection Association Life Safety Code (101) to be periodically tested and/or inspected; and any other items which, in the sole opinion of the Fire Code Administrator, are necessary for or relate to fire prevention and life safety. Section 9 clarifies that where a building contains multiple different occupancies, each occupancy is subject to a separate inspection.
Section 10 provides that if an inspection reveals potential violations of Chapter 239, the Fire Code Administrator will provide a written report to the structure's owner identifying such violations, the required form of correction, and the time period for completing such corrections. A structure's owner can appeal determinations contained within the inspection report to the Township's Building Code Board of Appeals. Failure to timely comply with an inspection report may result in the Fire Code Administrator prohibiting occupancy of the structure until corrections have been satisfactorily made. Section 11 provides that where a structure is determined to be in compliance with Chapter 239, the Fire Code Administrator will issue a Certificate of Fire Code Compliance. Such Certificate remains valid until a subsequent reinspection of the structure but may be revoked where a structure's owner prohibits such reinspection.
Section 12 identifies when and at what frequency inspections will occur. Beginning upon the effective date of the Ordinance, all Regulated Structures (as defined in the Ordinance) located within the Township are subject to inspections. After an initial inspection, a structure may thereafter be inspected once every two (2) years, or at any time where the Fire Code Administrator has a reasonable belief that the structure is not in compliance with Chapter 239. In addition to regular, periodic inspections, a Regulated Structure is subject to inspection upon: (i) its initial construction (if not in existence on the Ordinance's effective date); (ii) an expansion or change in use thereof; or (iii) a renovation or modification thereof. Section 13 identifies that the fee for inspections will be as set forth in the Township's duly-adopted fee schedule, which may be amended from time to time.
Section 14 addresses the Fire Code Administrator's discovery of immediate fire hazards and conditions dangerous to human life or property. In this event, the Fire Code Administrator may order the immediate evacuation of a structure and shall provide the structure's owner with a notice of violation identifying such fire hazard or dangerous condition, the corrective actions required, and the time for completion of such actions. If
the structure's owner fails to comply with the written notice, then the Township may cause the performance of such corrective actions at the structure's owner's expense, with the
cost thereof recoverable by the Township through the imposition of a municipal lien against the property.
Section 15 addresses ordinary violations of Chapter 239. Where the Fire Code Administrator suspects that a structure is in violation of Chapter 239, the Fire Code Administrator will issue a notice of violation to the structure's owner by personal delivery or regular mail to the owner's last known address. The notice of violation will identify the sections of Chapter 239 alleged to have been violated, the corrective actions required to remedy such violation, the time period for completing such actions, the right to appeal to the Township's Building Code Board of Appeals, and the potential penalties for failure to comply. A violation of Chapter 239 shall be treated as a summary criminal offense, punishable by a fine of not more than $1,000.00, and if the defendant fails to pay same, then imprisonment for a term not exceeding ninety (90) days. Finally, Section 16 contains a severability clause, Section 17 provides that the Ordinance controls over any preceding, conflicting Township ordinances, and Section 18 provides that the Ordinance shall become effectively immediately upon adoption.
