NOTICE OF PUBLIC HEARING AND POTENTIAL ADOPTION OF ZONING ORDINANCE AMENDMENT North Whitehall Township, Lehigh County, Pennsylvania In accordance with Section 609 of the Pennsylvania Municipalities Planning Code, Act of Jul. 31, 1968, P.L. 805, No. 247, Art. VI, § 609, as reenacted and amended (the "MPC"), 53 P.S. § 10609, notice is hereby given that the Board of Supervisors (the "Board") of North Whitehall Township, Lehigh County, Pennsylvania (the "Township"), will conduct a public hearing at the Township's administrative building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during the Board's regularly scheduled public meeting commencing at 7:00 P.M. on MONDAY, MAY 11, 2026, for the purpose of receiving public comment on proposed Ordinance No. 2026-7 (the "Ordinance"), which amends the Township's Zoning Ordinance's regulations pertaining to Data Center uses and Data Center Accessory Uses (as such terms are defined in the Zoning Ordinance). Notice is also hereby provided in accordance with Section 610 of the MPC, as reenacted and amended, 53 P.S. § 10610, and Section 1601 of Pennsylvania's Second Class Township Code, Act of 1933, P.L. 103, No. 69 (the "SCTC"), Art. XVI, § 1601, as reenacted and amended, 53 P.S. § 66601, that the Board will consider adoption of the Ordinance during the Board's regularly scheduled public meeting described above. The following constitutes the title of the Ordinance and a brief summary of the Ordinance's provisions in reasonable detail prepared by the Township Solicitor in accordance with Section 1601 of the SCTC, 53 P.S. § 66601. The title of the Ordinance is: "AN ORDINANCE AMENDING THE NORTH WHITEHALL TOWNSHIP ZONING ORDINANCE OF 2025 TO MODIFY REGULATIONS PERTAINING TO DATA CENTER USES AND DATA CENTER ACCESSORY USES." The purpose of the Ordinance is to amend the Township's Zoning Ordinance's regulations pertaining to Data Center uses and Data Center Accessory Uses that were recently enacted by the Board by virtue of Ordinance No. 2026-2, adopted on March 09, 2026. Section 1 of the Ordinance contains a statement of legislative findings that identifies the Borad's authority to adopt the Ordinance and the background and purpose of the Ordinance. Section 2 of the Ordinance contains the substantive amendment of the Zoning Ordinance, which includes the following changes: a new definition is added for the term "High Impact Data Center," which generally includes any Data Center that has a critical IT load at full-build out of fifty megawatts (50 MWs) or greater, or a group of Data Centers that has a cumulative critical IT load of fifty megawatts (50 MWs) or greater; Data Center and Data Center Accessory Uses are removed as Conditional Uses in the Township's Light Industrial/Business (LI/B) zoning district and confined to the Township's Mineral Extraction/Industrial (MEI) zoning district; a general decibel limit is established for all uses within the Township at 60 dBA during normal operations, and noise studies required as part of the Conditional Use approval process for a Data Center or Data Center Accessory Use must demonstrate compliance with said decibel limit; a new setback of three hundred feet (300') is established for Data Center uses and Data Center Accessory Uses, except where such uses border a residential zoning district or parcel developed with a Sensitive Receptor (as such term is defined in the Zoning Ordinance), in which case the setback requirement is increased to five hundred feet (500'); new specifications for required noise studies to be submitted as part of the Conditional Use approval process and after construction are added; specification is added that vibration studies submitted as part of the Conditional Use process must demonstrate compliance with the Zoning Ordinance's vibration standards; a requirement is added for annual reports of groundwater withdrawal for Data Centers that propose to utilize cooling systems other than closed-loop systems or other similar systems that do not require continuous groundwater withdrawal; and electrical demand and fuel storage disclosure requirements, infrastructure capacity reporting, and a requirement to identify impacts on existing utility infrastructure are added. Section 3 of the Ordinance contains a savings clause, and Section 4 of the Ordinance provides that it shall become effective immediately after adoption by the Board. Copies of the Ordinance may be examined without charge, or obtained for a fee no greater than the cost to the Township to reproduce the Ordinance, at the Township's administrative building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during normal business hours, Monday through Thursday, 7:30 a.m. through 5:00 p.m. In addition, and in accordance with Section 1601 of the SCTC, as reenacted and amended, 53 P.S. § 66601, and Section 610 of the MPC, as reenacted and amended, 53 P.S. § 10610, a full copy of draft Ordinance No. 2026-2 has been supplied to this newspaper and the Lehigh County Department of Law.
