WHITEHALL TOWNSHIP NOTICE TO BIDDERS The Township of Whitehall is accepting bids for the following project: BID #2026-01: "2026 ADA HANDICAP RAMPS, CURB AND SIDEWALK IMPROVEMENTS, DESIGN BUILD" Sealed bids will be received at the Whitehall Township Municipal Building, 3219 MacArthur Road, Whitehall, PA 18052, by Lenore Brazier, Purchasing Agent, or her designee, until 10:00 a.m., Local Time, on Wednesday, April 8, 2026, at which time they will be opened, in front of a Township Witness. Late bids will not be accepted. Bid security in the amount of ten percent (10%) of the bid price shall be submitted with the bid. Additional post-award bonding requirements for this project include a Performance Bond, a Labor and Material Payment Bond and a Maintenance Bond. In general, the Project involves the 2026 Design and Construction of thirty-six (36) ADA Handicap Ramp Corners along four (4) Project Areas within Whitehall Township. 1) Arlington Knolls Section (21) ADA Ramps 2) Alberta Drive (8) ADA Ramps from Sunset Drive to Georgia Drive 3) Georgia Drive (3) ADA Ramps from Presidential Dr. to Locust Alley 4) Fullerton Section 8th St. (4) ADA Ramps from American Street to Jefferson Street. The Arlington Knolls Section (21) ADA Ramps must be completed by July 1, 2026, in order to allow sufficient time for Street Paving. The remaining sections must be completed by August 3, 2026. The Contractor is also required to engage the services of a Professional Land Surveyor or Professional Engineer to Survey and Design (36) ADA Ramps for construction compliance with current ADA Standards. This project is subject to the Pennsylvania Prevailing Wage Act, approved August 15, 1961, P.L. 987 (Act No. 442), as amended and supplemented, and reference is made to the prevailing minimum wage rates applicable to this project which have been promulgated by the Secretary of Labor and Industry. Bidders shall have at least five (5) years past experience in ADA Ramps concrete curb and sidewalk work. The successful bidder is expected to be able to start work in May 1, 2026, and shall complete all work by August 3, 2026. Liquidated damages of $250 per calendar day will be assessed to the Contractor for any HC Ramps that are not completed by the August 3, 2026, completion date until its satisfactory completion. Whitehall Township reserves the right to determine, in its sole discretion, whether any aspect of a bid satisfactorily meets the criteria established in this Request for Bid, to accept either in whole or in part, any one bid or combination of bids, to waive or permit the curing of any immaterial defects informalities or irregularities in a bid as permitted by law, to reject any or all bids with or without cause, and to take any action which the Township deems appropriate. The Township intends to select that bid(s) which, in the sole opinion of the Township is/are most favorable and in the best interest of the citizens of Whitehall Township. NOTICE IS HEREBY GIVEN that on March 2, 2026, the Board of Supervisors of Penn Forest Township, Carbon County, Pennsylvania adopted Ordinance No. 1 of 2026 entitled "AN ORDINANCE OF THE TOWNSHIP OF PENN FOREST, COUNTY OF CARBON, COMMONWEALTH OF PENNSYLVANIA, AMENDING CHAPTER 240 (ZONING) OF THE CODE OF THE TOWNSHIP OF PENN FOREST, AND AMENDING THE PENN FOREST ZONING MAP." A brief statement of the general content of this Ordinance is as follows: 1. Zoning Map Amendment. The existing Penn Forest Township zoning map is amended to add a new DC Data Center Overlay District. The real property located in the DC Data Center Overlay District is owned by Mele Bros. Realty and identified by tax parcel numbers 53-51-A12, 67-51-A11.01, 67-51-A11.03, and 67-51-A16. 2. Section 240-26 (Definitions) is amended to add the following new definitions: Area of Influence (AOI); Data Center; Data Center Accessory Use; Fully Shielded; Groundwater; Light Trespass; Luminaire; Nadir; Recharge, Aquifer Recharge, or Groundwater Recharge; Sensitive Receptor; Specimen Tree; Water Body; and Watercourse. 3. Article IV, Districts, section 240-27, Designation of districts and purposes, is amended to add the DC Data Center Overlay District. 4. Article IV, Districts, section 240-32, Table of allowed uses in each zoning district, is amended to permit Data Centers and Data Center Accessory Uses in the DC Data Center Overlay District as conditional uses. 5. Article IV, Districts, section 240-33, Dimensional requirements in each district and site capacity, subsection A, is amended to add a reference to the DC Data Center Overlay District. 6. The "Table of Dimensional Requirements in Each District and Site Capacity" found at Attachment 2 in the Zoning Ordinance, is amended to provide for Data Centers and Data Center Accessory Uses. 7. A new section 240-40.2 is added which contains regulations regarding the dimensional requirements and site capacity in the DC Data Center Overlay District including, amongst other things, dimensional standards; requirements for buffer yards, provisions for equipment screening and fencing, noise and vibration, water and sewer, power supply, emergency management, architectural and design standards, parking and loading, electronic and other waste, environmental impact assessment, fiscal impact analysis, woodland protection and replacement, lighting, and decommissioning. 8. Article VI, Environmentally Sensitive Areas, is amended to delete section 240-48 entitled "Control of light and glare" in its entirety and replace it with a new section 240-48 entitled "Control of light and glare", which regulates exterior lighting in order to minimize glare, light trespass, and sky glow, and to protect adjoining properties and public rights-of-way, and reduce lighting conflicts between property owners. 9. Article VI, Environmentally Sensitive Areas, is amended to add a new section 240-48.1 entitled "Woodland protection and replacement" which provides woodland protection and replacement standards for trees, woodlands, and shrubs. 10. Article IX, General Regulations, section 240-62, Height exceptions, is amended to delete "water towers" and "heating/ventilation/air-conditioning equipment", and to limit other appurtenances to a maximum of four (4') feet in height. 11. Article IX, General Regulations, is amended to add a new section 240-67 entitled "Performance Standards" which provides performance standards for such things as air quality; fire and explosion hazards; glare and heat; waste disposal; noise; vibration; odor; electrical, radio, and electromagnetic disturbance; radioactivity; electrical, diesel, gas, or other power; water supply; ground and water contamination; and, general health and safety. 12. Article IX, General Regulations, is amended to add a new section 240-68 entitled "Impact assessments and studies" which is intended to provide for the identification of environmental and community impacts and means of mitigation of impacts of development projects in the Township. Where required, impact assessments and studies shall address such things as: potential environmental impacts; fiscal impact assessment; sound and vibration studies; and, water and sewer and water feasibility studies. As to each of the foregoing the amendments contain requirements as to what must be contained in the study.
