Notice is hereby provided pursuant to Subsection 1601(a) of the Second Class Township Code, Act of May 1, 1933, P.L. 103, No. 69, as amended (the "SCTC"), 53 P.S. § 66601(a), that the Board of Supervisors of Lowhill Township, Lehigh County, Pennsylvania (the "Board") intends to consider for adoption at its regularly scheduled public meeting commencing at 6:30 P.M. on MONDAY, APRIL 6, 2026, at the Lowhill Township Municipal Building located at 7000 Herber Road, New Tripoli, PA 18066, proposed Ordinance No. 2026-03 (the "Ordinance"). The purpose of the Ordinance is to create an Environmental Advisory Council (the "EAC") as authorized by Pennsylvania law. The following constitutes the title and a brief summary of the Ordinance, prepared by the Township Solicitor, setting forth the provisions of the Ordinance in reasonable detail in accordance with Subsection 1601(a) of the SCTC, 53 P.S. § 66601(a). The title of the Ordinance is: "AN ORDINANCE OF THE TOWNSHIP OF LOWHILL ESTABLISHING AN ENVIRONMENTAL ADVISORY COUNCIL AND STATING THE POWERS OF, AND OPERATING PROCEDURES FOR, THE COUNCIL AND FURTHER PROVIDING FOR THE MAKING OF APPROPRIATIONS TO FUND THE OPERATIONS THEROF." The Ordinance contains a statement of legislative findings identifying the Ordinance's purposes and setting forth the authority of the Board to adopt the Ordinance. Section II of the Ordinance set forth the substantive provisions, summarized as follows: the Ordinance a) establishes a three to five member EAC, appointed by the Board to advise the Township and others concerning certain conservation and environmental matters, including open space preservation and the preservation of agriculture and other environmental features such as wetlands and woodlands; b) grants to the EAC various powers including but not limited to making recommendations concerning the identification of environmental issues and concerns, c) authorizes the EAC to establish related plans and programs, d) authorizes the EAC to address the use and acquisition of open space, e) requires it to maintain an index of environmentally sensitive areas; f) authorizes it to advise concerning energy conservation and related programs and comment on land development plans; and g) authorizes it to perform other duties as assigned. The Board will designate the EAC chairperson. The EAC will operate in accordance with the Sunshine Law and may create its own meeting rules. The Board may budget appropriate funds for the EAC. The EAC is a recommending body, only. The Ordinance is effective immediately following enactment.
