Section 8001 et seq., which will, among other things, authorize the incurring of non-electoral debt through the issuance of the Borough's two Tax-Exempt General Obligation Notes: Series A of 2026 Note in the aggregate principal amount of $1,175,000.00 and Series B of 2026 Note in the aggregate principal amount of $2,050,000 to Mauch Chunk Trust Company; (the "Ordinance"). The title (which summarizes the provisions contained in the Ordinance) is as follows:
"AN ORDINANCE
OF THE BOROUGH COUNCIL OF THE BOROUGH OF TAMAQUA DETERMINING TO INCUR NON-ELECTORAL DEBT PURSUANT TO THE LOCAL GOVERNMENT UNIT DEBT ACT; DETERMINING THAT SUCH DEBT SHALL BE EVIDENCED BY TAX-EXEMPT GENERAL OBLIGATION NOTES TO BE AUTHORIZED AND ISSUED AS THE SERIES A NOTE IN THE MAXIMUM AGGREGATE PRINCIPAL AMOUNT OF $1,175,000.00 AND THE SERIES B NOTE IN THE MAXIMUM PRINCIPAL AMOUNT OF $2,050,000 (THE NOTES") BY THE BOROUGH OF TAMAQUA (THE "BOROUGH") TO MAUCH CHUNK TRUST COMPANY WITH THE PROCEEDS OF EACH OF THE NOTES, AND ANY INTEREST EARNED THEREON, TO BE USED TO: (1) FUND CONSTRUCTION OF A NEW BOROUGH POOL AND VARIOUS CAPITAL PROJECTS OF THE BOROUGH; AND (2) PAY COSTS, FEES AND EXPENSES OF ISSUING THE RESPECTIVE NOTE (THE "PROJECT"); PROVIDING THAT EACH NOTE, WHEN ISSUED, SHALL BE A GENERAL OBLIGATION NOTE OF THIS BOROUGH AND SHALL BE FULLY REGISTERED; DESCRIBING THE PROJECT FOR WHICH SAID DEBT IS TO BE INCURRED; DETERMINING THAT SAID NOTES SHALL BE SOLD AT PRIVATE SALE AND THAT A PRIVATE SALE BY NEGOTIATION IS IN THE BEST FINANCIAL INTEREST OF THIS BOROUGH; ACCEPTING A PROPOSAL FOR PURCHASE OF SAID NOTES AND AWARDING SUCH NOTES AND SETTING FORTH RELATED PROVISIONS; DETERMINING THE USEFUL LIFE OF THE PROJECT BEING FINANCED; FIXING THE SUBSTANTIAL FORM, DENOMINATIONS, DATE, MATURITY DATE, INTEREST RATE, INTEREST PAYMENT DATES, REGISTRATION, PLACE OF PAYMENT OF PRINCIPAL AND INTEREST, REDEMPTION PROVISIONS AND THE TAX-FREE PROVISIONS OF SUCH NOTES; SETTING FORTH THE FORM OF REGISTRATION AND ASSIGNMENT AND PAYING AGENT'S CERTIFICATES APPERTAINING TO SUCH NOTES; AUTHORIZING AND DIRECTING EXECUTION, ATTESTATION AND AUTHENTICATION OF SUCH NOTES; PROVIDING COVENANTS RELATED TO DEBT SERVICE APPLICABLE TO SUCH NOTES AS REQUIRED BY SUCH ACT AND THE PENNSYLVANIA CONSTITUTION AND PLEDGING THE FULL FAITH, CREDIT AND TAXING POWER OF THIS BOROUGH IN SUPPORT THEREOF; SETTING FORTH THE DEBT SERVICE RELATED TO SUCH NOTES; CREATING A SINKING FUND IN CONNECTION WITH EACH NOTE AS REQUIRED BY SUCH ACT; APPOINTING A SINKING FUND DEPOSITORY AND AUTHORIZING A CONTRACT WITH A BANK AS SUCH DEPOSITORY; PROVIDING A COVENANT TO INSURE PROMPT AND FULL PAYMENT OF ALL OBLIGATIONS OF SUCH NOTES WHEN DUE; AUTHORIZING AND DIRECTING THE PROPER OFFICERS OF THE BOROUGH: (A) TO PREPARE, CERTIFY AND FILE THE DEBT STATEMENT AND BORROWING BASE CERTIFICATE REQUIRED BY SECTION 8110 OF THE DEBT ACT; (B) TO EXECUTE, ATTEST, SEAL AND DELIVER THE NOTES; APPROVING THE FORM OF THE NOTES; SPECIFYING THE AMOUNT OF THE NOTES AND THE SOURCES OF PAYMENT OF EACH NOTE; AUTHORIZING AND DIRECTING THE PREPARATION, EXECUTION AND DELIVERY OF ALL OTHER REQUIRED DOCUMENTS BY THE PROPER OFFICERS OF THE BOROUGH AND AUTHORIZING SUCH OFFICERS TO TAKE ALL OTHER REQUIRED, NECESSARY OR DESIRABLE RELATED ACTION IN CONNECTION WITH THE PROJECT AND THE EXECUTION AND DELIVERY OF THE NOTES; DECLARING THAT THE DEBT TO BE INCURRED IS WITHIN THE LIMITATION IMPOSED BY SUCH ACT UPON THE INCURRING OF SUCH DEBT BY THIS BOROUGH; SETTING FORTH CERTAIN COVENANTS RELATING TO THE NON-ARBITRAGE STATUS OF SUCH NOTES; DESIGNATING THE NOTES AS QUALIFIED TAX EXEMPT OBLIGATIONS OF THIS BOROUGH UNDER THE INTERNAL REVENUE CODE AND MAKING CERTAIN CERTIFICATIONS CONSISTENT THEREWITH; MAKING THE NOTES SUBJECT TO SUCH ACT AND OTHER APPLICABLE LAWS OF THE COMMONWEALTH; PROVIDING FOR THE EFFECTIVENESS OF THIS ORDINANCE; PROVIDING FOR THE SEVERABILITY OF PROVISIONS OF THIS ORDINANCE; AND PROVIDING FOR THE REPEAL OF ALL INCONSISTENT ORDINANCES OR RESOLUTIONS OR PARTS OF ORDINANCES OR RESOLUTIONS."
Additions to or omissions from the Ordinance, as proposed, including with respect to the Bonds, the price paid, interest rate and debt service appropriations and any amendments thereto, will be supplied at the time of adoption of the Ordinance, if the Borough shall determine to proceed.

NOTICE TO BIDDERS
Washington Township will receive sealed bids online for "2026 Road Paving" on various roads located within the township until 11:00 AM, on Monday, May 4, 2026 at which time they will be opened and posted shortly thereafter. Sealed bids shall be submitted electronically via the PennBid Program. All document and solicitation details are available online at no cost at PennBid – www.pennbid.bonfirehub.com. The project consists of the following:
"In Place Paving" on various roads located in Washington Township, Lehigh County:
Base Bid Quantities:
2,800 Tons of 9.5mm Superpave, WMA 180 lb/sy Wearing Course
932 Tons of 9.5mm Superpave, WMA 60 lb/sy Leveling Course
Alternate Bid Quantities:
690 Tons of 9.5mm Superpave, WMA 180 lb/sy Wearing Course
231 Tons of 9.5mm Superpave, WMA 60 lb/sy Leveling Course
All materials must meet PENNDOT Pub. 408 Specifications and Standards. Bidders may be either a PENNDOT prequalified Prime or Sub Contractor and must supply proof of prequalification.
Questions and inquiries should be electronically submitted through PennBid's questions and answers tab. All bidders are invited to review the project with the Township.
All bids must be accompanied by a certified check or bid bond in the amount of ten (10%) percent of the bid made payable to Washington Township.
The successful bidder will be required to provide a Performance and Payment Bond in the amount of 100% of the contract price within 20 days of the award of the contract and a certificate of liability insurance acceptable to the municipality prior to the start of any work.
The bids will be presented to the Board of Supervisors at the regular scheduled meeting of the Washington Township Board of Supervisors on Tuesday May 5, 2026 at approximately 7:30 p.m., or as soon thereafter as the agenda allows.
The Washington Township Board of Supervisors reserves the right to accept or reject any and/or all proposals or portions thereof, and to delete projects and or portions of the project depending on budgetary constraints and to waive any technicalities deemed to be in the best interest of the Township.
PA Prevailing Wages apply to the "In Place Paving" contract.
