The relief requested is a dimensional variance from Bethlehem Township Zoning Ordinance Section 275-190.D(7)(b)[1][c], which requires that a fence located within a front yard be no higher than five feet; a variance from Bethlehem Township Zoning Ordinance Section 275-190.D(7)(b)[1][a], which requires that a fence located within a front yard be of open-picket design having a minimum 1:1 open to structural components; and, a dimensional variance from Bethlehem Township Zoning Ordinance Section 275-42.E(1), which requires a front yard setback for principal and accessory structures of 35 feet. Respectively, the applicant requests relief to permit a 6-foot-high privacy fence, thereby seeking a variance of 1 foot in height and a variance from the open-picket fence design requirement. Finally, the applicant requests relief to permit a patio with a 0-foot front yard setback, thereby seeking a variance of 35 feet. The real estate is located in the Light-Density residential (LDR) District, maintains Northampton County Tax Parcel Identification Number M7NW2 11 1 0205 and is described in Northampton County Deed Book Volume 2020-1, Page 086942. Appeal #14-2026 of Ambridge and Sons, LLC seeks relief concerning real estate located at 1741 3rd Street, Bethlehem Township, Northampton County. The appellant seeks to appeal a "Notice of Violation" issued by the Bethlehem Township Zoning Administrator on April 21, 2026. The Zoning Administrator issued a "Notice of Violation" to the appellant regarding installation of a driveway expansion without a permit in violation of Bethlehem Township Zoning Ordinance Section 275-8, installation of a gravel driveway without a permit in violation of Bethlehem Township Zoning Ordinance Section 275-8, construction of a gravel driveway which does not conform to standards of Bethlehem Township Zoning Ordinance Section 275-144.E(1), construction of a driveway expansion that does not conform to Bethlehem Township Standard Construction Documents standards in violation of Bethlehem Township Zoning Ordinance Section 275-10.B(2), and failure to obtain a state Highway Occupancy Permit for a driveway expansion along Freemansburg Avenue in violation of Bethlehem Township Zoning Ordinance Section 275-144.D(6). The appellant is seeking a determination that the challenged improvements were preexisting and in their current state when the property was purchased and therefore the Zoning Administrator's determination is invalid.
