NOTICE OF PUBLIC HEARING AND POTENTIAL ADOPTION OF ZONING ORDINANCE AMENDMENT North Whitehall Township, Lehigh County, Pennsylvania In accordance with Section 609 of the Pennsylvania Municipalities Planning Code, Act of Jul. 31, 1968, P.L. 805, No. 247, as reenacted and amended (the "MPC"), 53 P.S. § 10609, notice is hereby given that the Board of Supervisors (the "Board") of North Whitehall Township, Lehigh County, Pennsylvania (the "Township"), will conduct a public hearing at the Township's administrative building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during the Board's regularly scheduled public meeting commencing at 7:00 P.M. on MONDAY, AUGUST 10, 2026, for the purpose of receiving public comment on proposed Ordinance No. 2026-9 (the "Ordinance"), which amends the Township's Zoning Ordinance of 2025, as amended and codified. Notice is also hereby provided in accordance with Section 610 of the MPC, as reenacted and amended, 53 P.S. § 10610, and Section 1601 of The Second Class Township Code, Act of 1933, P.L. 103, No. 69 (the "SCTC"), as reenacted and amended, 53 P.S. § 66601, that the Board will consider adoption of the Ordinance during the Board's regularly scheduled public meeting described above. The following constitutes the title of the Ordinance and a brief summary of the Ordinance's provisions in reasonable detail prepared by the Township Solicitor in accordance with Section 1601 of the SCTC, 53 P.S. § 66601. The title of the Ordinance is: "AN ORDINANCE AMENDING THE NORTH WHITEHALL TOWNSHIP ZONING ORDINANCE OF 2025, AS AMENDED AND CODIFIED, TO REVISE PERMITTING REQUIREMENTS; TO AMEND THE DEFINITION OF THE TERM KENNEL AND THE USE REGULATIONS APPLICABLE TO KENNEL USES; TO ELIMINATE THE REGISTRATION FEES FOR ACCESSORY FAMILY DWELLING UNITS AND APIARIES; TO REVISE LIGHTING STANDARDS; TO ADD A LIMITATION ON THE NUMBER OF DRIVEWAYS SERVING A PROPERTY; TO ADD A REQUIREMENT FOR PROVISION OF EMERGENCY PULL-OFF AREAS FOR DRIVEWAYS EXCEEDING 500 FEET IN LENGTH; TO AUTHORIZE PET GROOMING ESTABLISHMENTS AS PRINCIPAL USES, INDUSTRIAL OFFICES AS PRINCIPAL USES, AND LIMITED PET GROOMING AS AN ACCESSORY USE AND ESTABLISH USE REGULATIONS FOR SUCH USES; AND TO REMOVE REFERENCES TO MAXIMUM BUILDING COVERAGE LIMITATIONS." The purpose of the Ordinance is to amend various provisions of the Township's Zoning Ordinance of 2025 relating to permits and certificates, defined terms, permitted uses, use regulations, lighting standards, and driveway design standards. Section 1 of the Ordinance contains a statement of legislative findings that identifies the Board's authority to adopt the Ordinance and the background and purpose of the Ordinance. The Ordinance's substantive amendments include, among other things, revisions to the "Permits and certificates" provisions to update and clarify the types of permits required (including zoning permits, building permits issued under the Pennsylvania Uniform Construction Code, and use and occupancy permits) and the general relationship among such permits. The Ordinance amends the definition of "Kennel" and revises the use regulations applicable to kennel uses. The Ordinance adds new defined terms and associated use provisions for "Pet Grooming Establishment," "Industrial Office," and "Limited Pet Grooming." The Ordinance amends the Table of Permitted Uses by district to authorize Industrial Office uses as permitted by right within the Light Industrial/Business (LI/B), Mineral Extraction/Industrial (ME/I), and Commercial (C) zoning districts, and to authorize Pet Grooming Establishment uses as permitted by right within the Commercial (C), Village (V), and Light Industrial/Business (LI/B) zoning districts. The Ordinance also specifies that Limited Pet Grooming is a form of Home Occupation Use permitted by special exception in all residential zoning districts. The Ordinance adds use regulations for Industrial Office uses, including screening requirements for outdoor storage. The Ordinance adds use regulations for Pet Grooming Establishments, including requirements that grooming occur within a fully enclosed structure, restrictions relating to outdoor grooming, standards relating to sewage disposal and water supply where on-lot systems are utilized, and noise-related operational requirements. The Ordinance adds use regulations for Limited Pet Grooming including eligibility criteria (including minimum lot area), operational standards, limitations on intensity, staffing, traffic/parking, hours of operation, signage, noise control, environmental controls, enforcement provisions, and expressly prohibited activities. The Ordinance further amends the apiary-related provisions of the Zoning Ordinance to revise the annual registration permit application requirements and documentation requirements and eliminates the registration fees for accessory family dwelling units and apiaries. The Ordinance also eliminates Use and Occupancy Permits (Certificates of Occupancy) and requires zoning permits upon changes in ownership or tenancy with respect to non-residential uses. The Ordinance revises lighting standards, including updating the measurement provisions and deleting certain existing provisions. The Ordinance amends driveway design standards to limit the number of driveway access points permitted per lot per street frontage and to require emergency pull-off areas for driveways exceeding 500 feet in length, including review by the Fire Code Administrator regarding pull-off area positioning. The Ordinance also amends the table of lot and setback requirements by district to remove a column contained therein identifying maximum building coverage limits. Section 3 of the Ordinance contains a severability clause, and Section 4 of the Ordinance provides that it shall take effect immediately upon enactment by the Board. Copies of the Ordinance may be examined without charge, or obtained for a fee no greater than the cost to the Township to reproduce the Ordinance, at the Township's administrative building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during normal business hours, Monday through Thursday, 7:30 a.m. through 5:00 p.m. In addition, and in accordance with Section 1601 of the SCTC, as reenacted and amended, 53 P.S. § 66601, and Section 610 of the MPC, as reenacted and amended, 53 P.S. § 10610, a full copy of draft Ordinance No. 2026-9 has been supplied to this newspaper and an attested copy has been filed with the Lehigh County Department of Law.
