Notice is also hereby provided in accordance with Section 610 of the MPC, as reenacted and amended, 53 P.S. § 10610, and Section 1601 of Pennsylvania's Second Class Township Code, Act of 1933, P.L. 103, No. 69 (the "SCTC"), Art. The following constitutes the title of the Ordinance and a brief summary of the Ordinance's provisions in reasonable detail prepared by the Township Solicitor in accordance with Section 1601 of the SCTC, as reenacted and amended, 53 P.S. § 66601.
The title of the Ordinance is: "AN ORDINANCE OF THE BOARD OF SUPERVISORS OF LOWHILL TOWNSHIP, LEHIGH COUNTY, PENNSYLVANIA, AMENDING THE LOWHILL TOWNSHIP ZONING ORDINANCE OF 2025 TO REPEAL ORDINANCE NO. 2026-2 IN ITS ENTIRETY; TO RESERVE SECTIONS 984 THROUGH 989 OF ARTICLE 900; TO ESTABLISH A NEW ARTICLE 1400 TITLED, 'DIGITAL INFRASTRUCTURE FACILITIES' CONSOLIDATING AND EXPANDING ALL REGULATIONS GOVERNING DIGITAL INFRASTRUCTURE FACILITIES; TO AMEND SECTION 917 RELATING TO PERFORMANCE STANDARDS; TO AMEND TABLE 1 OF SECTION 434 RELATING TO PRINCIPAL AND PERMITTED LAND USES; TO AMEND ARTICLE 300 RELATING TO DEFINITIONS; AND TO ADD A GENERALLY APPLICABLE PROVISION REGARDING PERMITS AND APPROVALS RUNNING WITH THE LAND"
The purpose of the Ordinance is to amend the Township's Zoning Ordinance to repeal Ordinance No. 2026-2 in its entirety, to reserve Sections 984 through 989, and to consolidate, expand, and reenact all regulations governing digital infrastructure facilities within a new Article 1400. The Ordinance consists of eleven (11) sections, as summarized below.
Section 1 contains a statement of legislative findings identifying the Board's authority to adopt the Ordinance and the background and purpose of the amendments. Section 2 repeals Ordinance No. 2026-2 in its entirety and supersedes all amendments to the Zoning Ordinance enacted by Ordinance No. 2026-2, including amendments to Article 300 (Definitions), Article 400 (Section 434, Table 1), and Article 900 (Sections 984 through 989). Section 3 deletes and reserves Sections 984 through 989 of Article 900. Section 4 amends Article 300 (Definitions) to add or amend definitions for the following terms: Aggregate Electrical Demand; Battery Energy Storage System; De Minimis Residential Compute System; Digital Infrastructure Facility; Distributed Compute Node System; Edge Computing Facility; Edge Computing Facility Accessory Use; Hyper Digital Infrastructure Facility (Hyper-DIF); Sensitive Receptors; and Thermal Impact Mitigation Plan (TIMP). Section 5 amends Article 400, Section 434, Table 1 (Principal and Permitted Land Uses) to provide that Edge Computing Facilities are permitted as a principal use by Conditional Use only in the Regional Use Overlay District 2 (RUO-2) zoning district; to confirm that Hyper Digital Infrastructure Facilities are permitted as a principal use by Conditional Use only in RUO-2; and to provide that De Minimis Residential Compute Systems and Distributed Compute Node Systems are permitted by right in all zoning districts as accessory uses subject to Article 1400 standards. Section 6 amends Article 1200 by adding a new Section 1231, providing that zoning permits, certificates of use, conditional use approvals, special exception approvals, variances, and all conditions of approval run with the land and are binding upon all subsequent owners, occupants, operators, lessees, successors, and assigns. Section 7 amends Section 917 (Performance Standards) by preserving and renumbering non-noise-related performance standards and replacing noise-related provisions with objective sound standards applicable to all uses, including digital infrastructure facilities, establishing measurement requirements, maximum sound levels, noise complaint investigation procedures, enforcement provisions, and continuing compliance obligations. Section 8 creates a new Article 1400 titled, "Digital Infrastructure Facilities." Article 1400 establishes purpose and applicability provisions; classifies digital infrastructure into tiers based on aggregate electrical demand, including Hyper Digital Infrastructure Facilities (above 50.0 megawatts), Edge Computing Facilities (up to and including 50.0 megawatts), Distributed Compute Node Systems (up to and including 50.0 kilowatts), and De Minimis Residential Compute Systems (up to and including 10.0 kilowatts); identifies where each tier is permitted; addresses future digital processing technologies; establishes standards for De Minimis Residential Compute Systems and Distributed Compute Node Systems; establishes conditional use standards for Edge Computing Facilities and Hyper Digital Infrastructure Facilities; and requires disclosure and evaluation of electrical demand, utility capacity, utility infrastructure impacts, backup generation, fuel storage, noise, cooling, water use, traffic, emergency planning, setbacks, and dimensional standards. Article 1400 further requires water resource impact statements; utility coordination; generator and fuel storage disclosure; closed-loop cooling preferences; cooling return flow and stormwater resiliency; emergency response plans; landscaping and buffer yards; screening; lighting; air quality standards; noise studies; electrical utility impact studies; fiber and telecommunications infrastructure disclosures; water conservation standards; electromagnetic interference controls; battery energy storage safety standards; construction traffic management plans; operations and maintenance plans; electronic waste plans; aesthetic design standards; parking; signage; relationship to other ordinances; decommissioning; additional Hyper-Digital Infrastructure Facility standards; facility aggregation and anti-circumvention rules; future expansion and reclassification rules; North American Electric Reliability Corporation (NERC) reliability standards; thermal impact mitigation requirements, including Thermal Impact Mitigation plan (TIMP) submission, thermal performance standards, and mitigation measures; and annual reporting obligations for energy consumption, water consumption, noise compliance, and emergency generator testing, including requirements for a publicly available online dashboard. Section 9 contains a severability clause, Section 10 is a general repealer, and Section 11provides that the Ordinance shall take effect immediately after enactment by the Board.
