PUBLIC NOTICE OF INTENT TO ADOPT A TAX ORDINANCE North Whitehall Township, Lehigh County, Pennsylvania Notice is hereby provided pursuant to Section 306 of the Local Tax Enabling Act, Act of Jun. 30, 1981, P.L. 128, No. 43, as amended (the "LTEA"), 53 P.S. § 6924.306, and Subsection 1601(a.1) of Pennsylvania's Second Class Township Code, Act of May 1, 1933, P.L. 103, No. 69, as reenacted and amended, 53 P.S. § 66601(a.1) ("Subsection 1601(a.1)"), that, subject to the approval of the ballot question described below by the electorate of North Whitehall Township (the "Township") at the General Election to be held on Tuesday, November 3, 2026, the Board of Supervisors of North Whitehall Township (the "Board") intends to consider passage of proposed Ordinance No. 2026-12 (the "Ordinance") at a public meeting to be held at 7:00 P.M. on MONDAY, NOVEMBER, 9, 2026, at the Township Municipal Building, 3256 Levans Road, Coplay, Pennsylvania 18037. If adopted, the Ordinance would impose an additional earned income tax of fifteen hundredths of one percent (0.15%) on North Whitehall Township residents, business entities domiciled within North Whitehall Township, and persons or business entities conducting business within North Whitehall Township, all for the purpose of funding the preservation of open space (the "Open Space Tax"). The Ordinance is proposed pursuant to the Act of Jan. 19, (1968) 1967, P.L. 992, No. 442, as amended, 32 P.S. § 5001 et seq. (the "Open Space Act"), and Section 301.1 of the LTEA, 53 P.S. § 6924.301.1. The following constitutes the title and a brief summary of the Ordinance's provisions in reasonable detail, the substantial nature of the Open Space Tax, the reason which, in the judgment of the Board, necessitates the imposition of the Open Space Tax, and the amount of revenue estimated to be derived from said tax, all as prepared by the Township's Solicitor in accordance with Subsection 1601(a.1) and Section 306 of the LTEA. In the General Election to be held on November 3, 2026, the Township's electorate will vote on a ballot question asking whether the Township should impose the Open Space Tax. Accordingly, the Board's consideration and adoption of the Ordinance is contingent upon the electorate's approval of the ballot question. If the ballot question is approved, the Board intends to consider and adopt the Ordinance at its public meeting on November 9, 2026. If the ballot question is not approved, the Board will not adopt the Ordinance, and the Open Space Tax will not be imposed. The title of the Ordinance is "AN ORDINANCE IMPOSING AN ADDITIONAL 0.15% EARNED INCOME TAX TO FUND THE PRESERVATION OF OPEN SPACE PURSUANT TO THE ACT OF JAN. 19, (1968) 1967, P.L. 992, NO. 442, AS AMENDED, AND TO INCORPORATE AS APPLICABLE THE PROVISIONS OF ARTICLE III OF CHAPTER 384 OF THE CODE OF THE TOWNSHIP OF NORTH WHITEHALL WITH RESPECT TO THE ADMINISTRATION, COLLECTION, AND ENFORCEMENT OF SAID TAX." If enacted, the Ordinance will become effective immediately upon enactment by the Board, although the Open Space Tax will not become effective until January 1, 2027. All other ordinances or parts thereof in conflict are repealed to the extent of such conflict. The Ordinance contains a statement of legislative findings and a savings clause. If the ballot question is approved, the Ordinance will be required by Subsection 7.1(a) of the Open Space Act, 32 P.S. § 5007.1(a), to implement the result of the referendum to be conducted during the General Election to be held on November 3, 2026, whereat the Township's electorate will vote on whether to approve a fifteen hundredths of one percent (0.15%) increase in the Township's earned income tax to fund the preservation of open space (the Open Space Tax, as defined above). If imposed, he Open Space Tax would be paid by Township residents, business entities domiciled within the Township, and persons or business entities conducting business within the Township. It is the judgment of the Board that the Open Space Tax is necessary to fund the preservation and acquisition of open space and take such other actions as authorized by the Open Space Act. The Open Space Tax would become effective January 1, 2027, and would continue without annual reenactment until repealed or amended in accordance with Subsection 7.1(a.4) of the Open Space Act, 32 P.S. § 5007.1(a.4). The Open Space Tax is estimated to generate approximately $1,080,000 during the calendar year 2027. Administration, collection, and enforcement of the Open Space Tax and the use of the funds generated thereby shall be governed by the Open Space Act, the LTEA, other applicable laws of the Commonwealth of Pennsylvania, and Article III of Chapter 384 of the Code of the Township of North Whitehall.
