The purpose of the Ordinance is to repeal Ordinance No. 2024-5, known as the "North Whitehall Township Streetlighting Assessment Ordinance" and codified in Chapter 370, Article V of the Township's Code of Ordinances (the "Code"), in its entirety, thereby eliminating, effective as of January 1, 2027, the uniform annual assessment imposed upon certain properties within the Township benefited by public lighting to help offset the Township's costs of operating streetlights (the "Streetlight Assessment"), and to provide that the Township's public lighting costs shall thereafter be paid out of the Township's general revenue fund. The following constitutes the title and a brief summary of the Ordinance, prepared by the Township Solicitor, setting forth all the provisions of the Ordinance in reasonable detail in accordance with Subsection 1601(a) of the SCTC, 53 P.S. § 66601(a). The title of the Ordinance is: "AN ORDINANCE OF THE BOARD OF SUPERVISORS OF NORTH WHITEHALL TOWNSHIP, LEHIGH COUNTY, PENNSYLVANIA, REPEALING ORDINANCE NO. 2024-5 (AS CODIFIED IN CHAPTER 370, ARTICLE V OF THE CODE OF THE TOWNSHIP OF NORTH WHITEHALL) IN ITS ENTIRETY, THEREBY ELIMINATING THE UNIFORM ANNUAL ASSESSMENTS FOR STREETLIGHTING COSTS; PROVIDING FOR THE TERMINATION OF THE ASSESSMENT AS OF JANUARY 1, 2027; AND DIRECTING THE TRANSFER OF ALL COLLECTED ASSESSMENT FUNDS TO THE TOWNSHIP'S GENERAL REVENUE FUND." The Ordinance contains a statement of legislative findings identifying the Ordinance's purposes and setting forth the authority of the Board to adopt the Ordinance. Section 2 repeals Ordinance No. 2024-5, adopted November 4, 2024, in its entirety, with such repeal to become effective as of January 1, 2027. The Township Treasurer, or his or her designee(s), is authorized and directed to cause the transfer of all funds held in the Township's separate account maintained for the Streetlight Assessment (the "Streetlight"), including any interest earned thereon, to the Township's general revenue fund as soon as practicable after January 1, 2027. Any payments of the Streetlight Assessment, interest, or other amounts collected on or after January 1, 2027, with respect to any Streetlight Assessment imposed prior to January 1, 2027, shall, upon receipt, be deposited directly into the Township's general revenue fund. Upon the transfer of all such funds, the Township Treasurer, or his or her designee(s), is authorized to cause the closure of the Streetlight Assessment Account. From and after January 1, 2027, all costs incurred by the Township in lighting and illuminating the highways, roads, and other public places of the Township shall be paid out of the Township's general revenue fund. Section 4 provides that the repeal of Ordinance No. 2024-5 shall not affect or impair any act done, assessment imposed, lien filed, action commenced, right accrued, liability incurred, or proceeding pending under Ordinance No. 2024-5 prior to January 1, 2027, and that all such assessments, liens, actions, rights, liabilities, and proceedings may be enforced, collected, and prosecuted to completion as though Ordinance No. 2024-5 had not been repealed.
