NOTICE IS HEREBY GIVEN THAT there will be a Meeting of the Penn Forest Township Zoning Hearing Board on Thursday, November 6, 2025 at 6:00 P.M. at the Penn Forest Township Volunteer Fire Company, 1387 State Route 903, Jim Thorpe, PA 18229, originally scheduled to be held on October 16, 2025, to hear the following: The property subject to this hearing is located at or near the intersection of State Route 903 and Maury Road, Penn Forest Township, Carbon County, Pennsylvania 18229 and is in an R-2 zone. The property is identified as Parcel ID 67-51-A16.01; 67-51-A17, 17.01; 67-51-A18, 67-51-A20, 67-51-A11.01, 67-51-A16, 67-51-A14.07, 67-51-A11.03, and 53-51-A12. Applicant and Challenger is Mele Bros. Realty, 2826 Mount Carmel Avenue, Suite 2, Glenside, Pennsylvania 19038. Challenger seeks to build a data center. Challenger submits a Substantive Validity Challenge pursuant to 53 P.S. §10916.1(a)(1) arguing that §240-11B of the Penn Forest Township Zoning Ordinance which states "[i]f a use clearly is not permitted by right, as a conditional use, or as a special exception use by the [Zoning Ordinance] within any zoning district, the use is prohibited, except that the Zoning Hearing Board may permit use as a special exception" under certain circumstances is invalid and unconstitutional. Challenger requests the Zoning Hearing Board determine that the challenge has merit, that the Zoning Ordinance stated above is invalid and unconstitutional for excluding data centers within the jurisdictional limits of the Township and that Challenger should be granted site-specific relief.
