Appeal #17-2025 of Ann Gillette seeks relief concerning real estate located at 4002 Tamarind Drive, Bethlehem Township, Northampton County. The applicant is seeking to construct an elevated deck greater than four feet above average grade which is required by Bethlehem Township Zoning Ordinance Section 275-190.D(5)(e) to meet setback criteria for a principal structure. The relief requested is a dimensional variance from Bethlehem Township Zoning Ordinance Section 275-49.G(1), which requires a minimum rear yard setback for a principal structure of 35 feet. The applicant requests a 19-foot rear yard setback, thereby seeking a variance of 16 feet. Appeal #18-2025 of TSV-HPIII Lehigh Valley, LLC seeks relief concerning real estate located at 3311 Farmersville Road, Bethlehem Township, Northampton County. The applicant is seeking three dimensional variances related to the minimum development requirements of the Bethlehem Township's Zoning Ordinance Streetscape Enhancement Overlay District. The first variance that the applicant seeks is a dimensional variance from Bethlehem Township Zoning Ordinance Section §275-261.J(3), which requires the street edge to have a setback from the designated streetscape enhancement right-of-way of no less than five feet and no greater than 25 feet. The applicant is requesting a setback of 0.78 feet from the designated streetscape enhancement right-of-way, thereby seeking a variance of 4.22 feet. The second variance that the applicant seeks is a dimensional variance from Bethlehem Township Zoning Ordinance Section §275-261.D(1), which requires that street trees be provided at regular intervals along both sides of a designated streetscape enhancement right-of-way. Finally, the applicant seeks a dimensional variance from Bethlehem Township Zoning Ordinance Section §275-261.D(2), which requires one street tree to be provided for every 50 linear feet of lot frontage abutting each side of a designated streetscape enhancement right-of-way. Again, the applicant requests to allow street trees at irregular intervals along both sides of the designated streetscape enhancement right-of-way, thereby seeking relief from the requirement of one street tree for every 50 linear feet of lot frontage. The real estate is located in the Planned Commercial (PC) District and Commercial Enhancement Overlay District, maintains Northampton County Tax Parcel Identification Number M7SE2 3 32 0205 and is described in Northampton County Deed Book Volume 2022-1, Page 274029.
