NOTICE OF PUBLIC HEARING AND POTENTIAL ADOPTION OF AMENDMENT TO SUBDIVISION AND LAND DEVELOPMENT ORDINANCE North Whitehall Township, Lehigh County, Pennsylvania In accordance with Section 505 of the Pennsylvania Municipalities Planning Code, Act of Jul. 31, 1968, P.L. 805, No. 247 (the "MPC"), Art. VI, § 505, as reenacted and amended, 53 P.S. § 10505, notice is hereby given that the Board of Supervisors (the "Board") of North Whitehall Township, Lehigh County, Pennsylvania (the "Township"), will conduct a public hearing at the Township's administrative building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during the Board's regularly scheduled public meeting commencing at 7:00 P.M. on MONDAY, MAY 11, 2026, for the purpose of receiving public comment on proposed Ordinance No. 2026-6 (the "Ordinance"), which amends the Township's Subdivision and Land Development Ordinance (the "SALDO"). Notice is also hereby provided in accordance with Section 506 of the MPC, as reenacted and amended, 53 P.S. § 10506, and Section 1601 of The Second Class Township Code, Act of 1933, P.L. 103, No. 69 (the "SCTC"), Art. XVI, § 1601, as reenacted and amended, 53 P.S. § 66601, that the Board will consider adoption of the Ordinance during the Board's regularly scheduled public meeting described above. The following constitutes the title of the Ordinance and a brief summary of the Ordinance's provisions in reasonable detail prepared by the Township Solicitor in accordance with Section 1601 of the SCTC, 53 P.S. § 66601 The title of Ordinance is: "AN ORDINANCE AMENDING THE NORTH WHITEHALL TOWNSHIP SUBDIVISION AND LAND DEVELOPMENT ORDINANCE OF 1999 AS AMENDED AND CODIFIED IN CHAPTER 375 OF THE CODE OF THE TOWNSHIP OF NORTH WHITEHALL TO ADOPT NEW TOWNSHIP INFRASTRUCTURE CONSTRUCTION SPECIFICATIONS AND DETAILS AND TO AMEND REQUIREMENTS RELATED TO REQUESTS FOR MODIFICATIONS (WAIVERS)." The purpose of the Ordinance is to amend the SALDO to replace and supplement existing construction specifications and details for Township infrastructure constructed in connection with land developments and subdivisions that may be offered for dedication to the Township, and to institute a standardized form to be utilized by applicants seeking waivers or deferrals of SALDO requirements. Section 1 of the Ordinance contains a statement of legislative findings that identifies the Board's authority to adopt the Ordinance and the background and purpose of the Ordinance. Section 2 of the Ordinance contains the substantive amendment of the SALDO, which includes adopting new construction specifications and details prepared by the Township Engineer and updating internal cross references within the SALDO that relate to existing specifications and details that will be replaced upon the adoption of said, new construction specifications and details. Additionally, Section 2 modifies the SALDO's provisions addressing requests for modifications (waivers and deferrals) from SALDO requirements. More specifically, a provision is added which allows the Board to approve requests for modifications without prior review by the Township's Planning Commission where such request relates solely to a procedural matter, such as submission deadlines. Finally, a new "Waiver Request Form" is to be added as an appendix to the SALDO and must be utilized by applicants in connection with modification requests. Section 3 of the Ordinance contains a savings clause, and Section 4 of the Ordinance provides that the Ordinance shall become effective immediately after adoption by the Board. Copies of the Ordinance may be examined without charge, or obtained for a fee no greater than the cost to the Township to reproduce the Ordinance, at the Township's administrative building located at 3256 Levans Road, Coplay, Pennsylvania 18037, during normal business hours, Monday through Thursday, 7:30 a.m. through 5:00 p.m. In addition, and in accordance with Section 1601 of the SCTC, as reenacted and amended, 53 P.S. § 66601, and Section 610 of the MPC, as reenacted and amended, 53 P.S. § 10610, a full copy of draft Ordinance No. 2026-6 has been supplied to this newspaper and the Lehigh County Department of Law.
