BEFORE THE BOROUGH COUNCIL OF THE BOROUGH OF EMMAUS LEHIGH COUNTY, PENNSYLVANIA ORDINANCE NO. 1292 AN ORDINANCE OF THE BOROUGH OF EMMAUS, LEHIGH COUNTY, PENNSYLVANIA, AMENDING CHAPTER 15 §602.3.A OF THE EMMAUS BOROUGH CODE, ADDING RESIDENTIAL DISABLED PARKING SIGN AND ASSIGNING PERMITTED PARKING SPACE ON A PUBLIC STREET LOCATED IN FRONT OF 26 N 4th STREET WITHIN THE BOROUGH OF EMMAUS WHEREAS, the Borough of Emmaus, Lehigh County, Pennsylvania, is authorized by the Pennsylvania Borough Code to establish parking restrictions on the public streets located within the Borough; and WHEREAS, Chapter 15 §602.3.A of the Emmaus Borough Code establishes Disabled Parking restrictions on public streets within the Borough; and WHEREAS, Emmaus Borough Council recently adopted Ordinance No. 1204, allowing Borough Council to assign permitted parking spaces to certain residents in accordance with Title 75, Section 3354(d)(2.1) and in accordance with Section 6109; and WHEREAS, the individual living at the residence located at 368 Broad Street in the Borough of Emmaus, qualifies for a permitted disabled parking space; and WHEREAS, the Borough Council of the Borough of Emmaus desires to amend Chapter 15 §602.3.A to add certain permitted Disabled Parking space on Borough streets; and NOW THEREFORE BE IT ORDAINED AND ENACTED, that the Council of the Borough of Emmaus hereby amends Chapter 15 §602.3.A of the Emmaus Borough Code authorizing the installation of the disabled parking sign and assigned permitted parking space at the following location: 1. In the public street located at 26 N 4th Street.The permit number for the assigned location shall be M86588P. BE IT FURTHER ORDAINED AND ENACTED that the officers and employees of the Borough of Emmaus are hereby empowered and directed to erect such signs and street markings as may be necessary to notify the public of this Ordinance, and to issue citations for violations thereof, pursuant to the Codified Ordinances of the Borough and the Motor Vehicle Code. BE IT FURTHER ORDAINED, that all existing Ordinances of the Borough or parts thereof inconsistent with the provisions of this Ordinance are hereby repealed. BE IT FURTHER ORDAINED, that if any section or provision of this Ordinance is declared by any Court of competent jurisdiction to be unconstitutional, illegal or invalid, such unconstitutionality, illegality or invalidity shall not affect the constitutionality, legality or validity of this Ordinance as a whole, nor the constitutionality, legality or validity of any other section or provision of this Ordinance other than the one so declared to be unconstitutional, illegal or invalid.
