William Fontaine, II, 57 Sunset Drive, Jim Thorpe, PA 18229, who contends that the Penn Forest Board of Supervisors abused its discretion, acted arbitrarily and capriciously and acted contrary to the purpose and intent of the Township Zoning Ordinance and its decision is contrary to Pennsylvania law in approving a change to the Zoning Map in Ordinance 1 of 2026 and that Ordinance 1 of 2026 constitutes spot zoning, that the DC Overlay is not consistent with the Township's Zoning Ordinance and the Township Comprehensive Plan, that the Curative Amendment is tailored to a specific developer or project, and that the Curative Amendment primarily enables a private use. Challenger seeks that the Zoning Hearing Board declare invalid the decisions of the Board of Supervisors on March 2, 2026 amending the zoning map of Penn Forest Township and adopting a curative amendment the Zoning Ordinance.
